General Terms and Conditions

Purpose and scope of application

These General Conditions of Contract are intended to regulate the relationship between MARALBA LUX, SL, provided CIF B56868136 (hereinafter KONECTAS) and the Customer of the website in relation to all transactions made in our online store located on the portal www.KONECTAS.com.

In order to purchase any product or service from the website, the user must be of legal age.

To date, KONECTAS only carries out transactions in Spain.

Purchase process.

Any doubt in the purchase process can be solved by sending an e-mail to info@konectas.com.

1º The purchase process starts when the user selects the desired item and clicks on the “Buy” option.

2º The user will be directed to a new page where he/she must confirm that he/she wants to register in KONECTAS and become part of the community.

3º Once you have selected “Join now!” you will continue with the process.

4º In the option “Cancel order” it will be possible to suppress and cancel the order. If the user wishes to finalize the purchase, he/she must click on “Go to Checkout”.

5º The user will only be able to be registered in the page once he/she has paid the registration fee and will have all the rights to cancel the service.

6º The user will be able to make the payment by credit card through a virtual T.P.V. gateway provided by Servired/Redsys®. Payment can also be made by bank transfer. In this case, the customer should send an email to info@konectas.com and we will contact you as soon as possible.

7º The user must accept the present General Conditions of Contract in order to be able to register with konectas.

8º Finally, once the information has been reviewed, the user must click on “Checkout”.

9ª Except for those users who, according to the provisions of paragraph 6 have opted for another means of payment, after accepting the order, will be redirected to the payment gateway and, once processed, the correct processing of the order will be confirmed by receiving an email.

11º The user will be able to follow up his registration by accessing the option enabled in his private area.

The user who has registered will be able to consult in his private area in which stage his procedure is, being the referred stages, the following ones:

1º Confirmation: Once the payment has been confirmed, the order will be considered to have been placed and a confirmation e-mail will be sent to the user.

2nd Phase of processing registration in Konectas:

The user will receive an email with the contract and registration documents to proceed with the registration in KONECTAS.

Notwithstanding the provisions of point 6, the user is informed that if the customer wishes to stop or cancel the order, he/she should immediately contact info@konectas.com (611.72.00.55) and KONECTAS will try to stop the process, and the customer must pay the costs incurred by such cancellation.

3rd Phase of Registration in konectas: Once the customer confirms the contract and attachments to join konectas, we will proceed to send all access and documentation to join the community. Once the order is in this phase, it will not be possible to cancel the order.

Prices and payment

4.1 Pricing

The prices applicable to each product are those indicated on the website on the date of the order.

The price published on the website does NOT include Value Added Tax (VAT).

Offers and rebates” shall be duly marked and identified as such, conveniently indicating the previous price and the current price of the offer.

KONECTAS reserves the right to modify the website at any time and without prior notice, and may update the services on a daily basis according to the market.

4.2 Form of payment

In accordance with point 2.6, the customer may pay by credit card through a virtual T.P.V. gateway provided by Servired/Redsys®.

If the user wishes to pay by another payment method, please send an email to info@konectas.com and we will contact you as soon as possible.

Receipt of order

Once the entire phase is completed, the customer will become a member of konectas.

If, for any reason, there is a delay in registering the user in konectas, konetas will duly inform the user and will try to find an adequate solution.

In any case, KONECTAS is not responsible for any incidents, delays or anomalies of any kind caused by third parties, being these the only ones responsible for such inconveniences.

Return Policy and Right of Withdrawal

According to the current legislation on electronic commerce, the customer may withdraw from the contract during the first 14 days from the day following the day of the contract.

If the customer considers that the service offered by konectas does not correspond to the order placed, within 8 days from the altar, must send an email to info@konectasi.com explaining what happened. In that case, if it turns out that the service does not match what was requested, konectas will proceed to refund the payment made and proceed to the cancellation of the service, without the customer incurring any additional costs.

Formalization of the contract

From the moment of the confirmation of the purchase, the user acquires the status of KONECTAS Client as described in these General Terms and Conditions. Any service offered subsequently must be the subject of a new contract.

At the moment the user signs the contract with konectas, the contract will be considered as perfected.

If the Customer wishes to read the General Terms and Conditions in more detail, he/she can print them on paper or save the document in electronic format.

KONECTAS archives the electronic documents in which purchases are formalized.

In case the Customer makes a mistake when sending the data, he/she can modify them by sending an e-mail to the following address: info@konectas.com stating in the subject of the e-mail that it is a data modification.

Language

To date, konectas only provides the service in Spain, so any contract will be formalized in Spanish language, without prejudice that later konectas will make it possible to make the purchase in other areas and other languages will be provided.

Responsibilities of KONECTAS.

KONECTAS guarantees the quality of the services contracted through the Web www.konectas.com. All rights guaranteed to consumers and users by the laws in force are guaranteed.

KONECTAS undertakes to act diligently and with the utmost contractual good faith in its obligations, informing the Customer at all times of any incidents or particularities that may affect the service.

Likewise, KONECTAS is committed to respond to all suggestions, complaints or questions that Customers send to the e-mail address info@konectas.com.

User Responsibilities.

The user guarantees the truthfulness and accuracy of the data provided when filling in the contracting forms, especially as far as notification channels are concerned (e-mail) avoiding causing damage to the provider as a result of such inaccuracy.

Failure to comply with any of these General Conditions may result in the cancellation of the products and services contracted without prior notice to the Customer and without entitlement to any compensation.

The user will inform KONECTAS at all times via email info@konectas.com of any relevant information regarding the products or services contracted.

Jurisdiction and Applicable Law

In the event of any conflict or discrepancy arising in the interpretation or application of these contractual conditions, the Courts and Tribunals which, if applicable, will hear the matter, shall be those provided for in the applicable legal regulations on competent jurisdiction, in which, in the case of end consumers, the place of performance of the obligation or the domicile of the purchasing party is taken into account.

In the case of a contract made by a company, both parties submit, expressly waiving any other jurisdiction, to the Courts and Tribunals of Barcelona.
